COURSIVITY<\/strong><\/p>\n\n\n\n

Refund Policy<\/strong><\/p>\n\n\n\n

This Refund Policy governs subscription payments processed for Coursivity platform memberships and transactions conducted between Students and independent Vendors (Instructors) on the Coursivity platform.<\/p>\n\n\n\n

By subscribing to a plan or making a purchase on Coursivity, you agree to this policy.<\/p>\n\n\n\n

1. Membership Subscription Refund Policy<\/h1>\n\n\n\n

(Subscriptions Processed by Payfast)<\/em><\/p>\n\n\n\n

Coursivity uses Payfast for subscription billing. This means:<\/p>\n\n\n\n

    \n
  • Payfast processes payments on behalf of Coursivity.<\/li>\n\n\n\n
  • Billing descriptors may reflect Payfast.<\/li>\n\n\n\n
  • Refunds for subscriptions are processed through Payfast in accordance with this policy.<\/li>\n<\/ul>\n\n\n\n

    Coursivity offers the following membership plans:<\/p>\n\n\n\n

    • Silver Plan (Free)<\/li>\n\n\n\n
    • Gold Plan (30-Day Free Trial, then paid subscription)<\/li>\n\n\n\n
    • Platinum Plan (Paid subscription)<\/li>\n<\/ul>\n\n\n\n

      1.1 Silver Plan (Free)<\/h2>\n\n\n\n

      The Silver Plan is free of charge. No payment is collected; therefore, no refund applies.<\/p>\n\n\n\n

      1.2 Gold Plan (30-Day Free Trial)<\/h2>\n\n\n\n

      The Gold Plan includes a 30-day free trial.<\/p>\n\n\n\n

        \n
      • No charges apply during the trial period.<\/li>\n\n\n\n
      • You must cancel before the trial ends to avoid billing.<\/li>\n\n\n\n
      • If not cancelled, Payfast will automatically process payment for the first billing cycle.<\/li>\n<\/ul>\n\n\n\n

        Refund Terms (Gold Plan)<\/h3>\n\n\n\n
          \n
        • If the free trial has been used, no refund will be issued once the first paid billing cycle begins.<\/li>\n\n\n\n
        • No refunds are issued for partial months.<\/li>\n\n\n\n
        • No refunds are issued after the first full month of paid membership has been completed.<\/li>\n\n\n\n
        • Failure to cancel before renewal does not entitle you to a refund.<\/li>\n<\/ul>\n\n\n\n

          1.3 Platinum Plan (Paid Subscription)<\/h2>\n\n\n\n

          The Platinum Plan is billed monthly or yearly and processed through Payfast.<\/p>\n\n\n\n

          If a free trial is included and used:<\/strong><\/p>\n\n\n\n

            \n
          • No refunds are available once the first paid billing cycle begins.<\/li>\n<\/ul>\n\n\n\n

            If no free trial applies:<\/strong><\/p>\n\n\n\n

              \n
            • Cancellation must occur before the next billing date.<\/li>\n\n\n\n
            • No refunds are issued for partial months.<\/li>\n\n\n\n
            • No refunds are issued after the first full month of paid membership has been completed.<\/li>\n<\/ul>\n\n\n\n

              1.4 Payfast Processing and Authority<\/h2>\n\n\n\n

              As the payment provider for Coursivity, Payfast:<\/p>\n\n\n\n

                \n
              • Has the authority to process payments and approved refunds.<\/li>\n\n\n\n
              • May review refund requests to prevent fraud or abuse.<\/li>\n\n\n\n
              • May decline refund requests that violate this policy.<\/li>\n<\/ul>\n\n\n\n

                All approved subscription refunds are processed back to the original payment method.<\/p>\n\n\n\n

                Coursivity reserves the right to deny refund approvals that do not comply with this policy.<\/p>\n\n\n\n

                1.5 Non-Refundable Situations<\/h2>\n\n\n\n

                Refunds will not be issued for:<\/p>\n\n\n\n

                  \n
                • Used free trials.<\/li>\n\n\n\n
                • Failure to cancel before renewal.<\/li>\n\n\n\n
                • Downgrades from a higher-tier plan.<\/li>\n\n\n\n
                • Unused features or tools within your subscription.<\/li>\n\n\n\n
                • Account suspension due to policy violations.<\/li>\n\n\n\n
                • Termination for breach of the Terms of Service or User Agreement.<\/li>\n\n\n\n
                • Chargebacks initiated without first contacting Coursivity support.<\/li>\n<\/ul>\n\n\n\n

                  2. Course and Digital Product Transaction Refund Policy<\/h1>\n\n\n\n

                  (Student Purchases from Independent Vendors \/ Instructors)<\/em><\/p>\n\n\n\n

                  Coursivity is a software service platform. Coursivity does not create, author, sell, deliver, or guarantee any Courses or Digital Products listed by Vendors.<\/strong><\/p>\n\n\n\n

                  For all Course and Digital Product transactions:<\/p>\n\n\n\n

                    \n
                  • Coursivity is not the seller, merchant of record, educator, or provider.<\/li>\n\n\n\n
                  • Payfast does not process Vendor Course or Digital Product payments.<\/li>\n\n\n\n
                  • Vendors use their own independent payment gateways chosen during their store setup.<\/li>\n\n\n\n
                  • All purchases made through Vendor listings are transactions solely between the Student and the Vendor.<\/li>\n<\/ul>\n\n\n\n

                    2.1 Vendor Responsibility<\/h2>\n\n\n\n

                    Each Vendor is independently and exclusively responsible for:<\/p>\n\n\n\n

                      \n
                    • Setting and publishing their own refund and cancellation policy on their Store page.<\/li>\n\n\n\n
                    • Handling all cancellation and refund requests from Students.<\/li>\n\n\n\n
                    • Managing and resolving all disputes with Students.<\/li>\n\n\n\n
                    • Processing refunds through their own payment gateway.<\/li>\n\n\n\n
                    • Delivering all Course Content, digital downloads, and services as described in their listings.<\/li>\n\n\n\n
                    • Ensuring the accuracy, quality, and legality of all Course Content they publish.<\/li>\n<\/ul>\n\n\n\n

                      2.2 No Liability for Vendor Refunds<\/h2>\n\n\n\n

                      Coursivity:<\/strong><\/p>\n\n\n\n

                        \n
                      • Does not hold Student funds for Vendor transactions.<\/li>\n\n\n\n
                      • Does not process Vendor refunds.<\/li>\n\n\n\n
                      • Is not responsible for Vendor performance, course quality, or delivery.<\/li>\n\n\n\n
                      • Is not liable for Course Content accuracy, completeness, inaccuracy, errors, omissions, or outdated material.<\/li>\n\n\n\n
                      • Is not liable for product or service quality, cancellations, damages, dissatisfaction, or any harm arising from reliance on Course Content.<\/li>\n\n\n\n
                      • Is not liable for any loss, injury, or damage (including physical, financial, professional, reputational, or emotional harm) resulting from a Student\u2019s use of or reliance on any Course or Digital Product.<\/li>\n<\/ul>\n\n\n\n

                        Students must contact the Vendor directly for any refund, cancellation, or dispute relating to a Course or Digital Product purchase.<\/strong><\/p>\n\n\n\n

                        2.3 Course-Specific Refund Considerations<\/h2>\n\n\n\n

                        Students should be aware of the following before purchasing any Course or Digital Product:<\/p>\n\n\n\n

                          \n
                        • Digital products (e-books, templates, downloadable files) are typically non-refundable once delivered or downloaded.<\/li>\n\n\n\n
                        • Online courses with immediate access may be non-refundable once the Student has accessed any portion of the Course Content.<\/li>\n\n\n\n
                        • Each Vendor\u2019s refund terms may differ. Students must read and accept the Vendor\u2019s Terms and Conditions before completing a purchase.<\/li>\n\n\n\n
                        • Coursivity does not mediate, arbitrate, or adjudicate refund disputes between Students and Vendors.<\/li>\n\n\n\n
                        • Completion certificates issued through the Platform are generated by Vendor configuration and have no independent monetary value. Refund eligibility is not affected by whether a certificate was or was not issued.<\/li>\n<\/ul>\n\n\n\n

                          2.4 Payment Disputes and Chargebacks (Vendor Transactions)<\/h2>\n\n\n\n

                          For Course and Digital Product purchases made through Vendor payment gateways:<\/p>\n\n\n\n

                            \n
                          • Any chargeback must be handled by the Vendor and their payment provider directly.<\/li>\n\n\n\n
                          • Coursivity bears no financial responsibility for Vendor chargebacks.<\/li>\n\n\n\n
                          • Vendors may face account suspension or termination for excessive disputes or chargebacks.<\/li>\n\n\n\n
                          • Students who initiate fraudulent chargebacks may have their Coursivity accounts suspended.<\/li>\n<\/ul>\n\n\n\n

                            3. Subscription Chargebacks (Payfast Transactions)<\/h1>\n\n\n\n

                            For subscription payments processed by Payfast:<\/p>\n\n\n\n

                              \n
                            • Students must contact Coursivity support before initiating a chargeback.<\/li>\n\n\n\n
                            • Unauthorised chargebacks may result in account suspension.<\/li>\n\n\n\n
                            • Fraudulent chargebacks may be disputed by Payfast on Coursivity\u2019s behalf.<\/li>\n\n\n\n
                            • Coursivity reserves the right to recover costs associated with fraudulent or frivolous chargebacks, including administrative and legal fees.<\/li>\n<\/ul>\n\n\n\n

                              4. Platform Role Clarification<\/h1>\n\n\n\n

                              Coursivity is a technology platform that:<\/strong><\/p>\n\n\n\n

                                \n
                              • Provides course marketplace infrastructure and tools for Vendors to create, host, and sell Courses.<\/li>\n\n\n\n
                              • Enables Vendor listings, storefronts, and checkout integration.<\/li>\n\n\n\n
                              • Facilitates subscription access to platform tools and features.<\/li>\n\n\n\n
                              • Provides software for course creation, student management, and analytics.<\/li>\n<\/ul>\n\n\n\n

                                Coursivity does not:<\/strong><\/p>\n\n\n\n

                                  \n
                                • Act as a Vendor\u2019s agent, employer, partner, or representative.<\/li>\n\n\n\n
                                • Create, author, edit, review, verify, endorse, or certify any Course Content.<\/li>\n\n\n\n
                                • Guarantee Vendor performance, course quality, or learning outcomes.<\/li>\n\n\n\n
                                • Assume liability for any Vendor\u2019s contractual obligations to Students.<\/li>\n\n\n\n
                                • Act as an educational institution, accredited body, or certification authority.<\/li>\n\n\n\n
                                • Guarantee the accuracy, completeness, or currency of any Course Content published by Vendors.<\/li>\n\n\n\n
                                • Provide any warranty, express or implied, regarding the fitness, suitability, or value of any Course or Digital Product.<\/li>\n<\/ul>\n\n\n\n

                                  The availability of a Course on the Platform does not constitute a recommendation, endorsement, approval, or certification by Coursivity of the Course, its Content, or the Vendor.<\/p>\n\n\n\n

                                  5. Consumer Protection Notice<\/h1>\n\n\n\n

                                  Where a Student is located in a jurisdiction with mandatory consumer protection laws that provide refund rights which cannot be waived by contract (including, without limitation, the South African Consumer Protection Act 68 of 2008, EU Consumer Rights Directive 2011\/83\/EU, or equivalent legislation), nothing in this Refund Policy shall limit the rights of such Student under those mandatory laws.<\/p>\n\n\n\n

                                  In such cases, the Vendor remains solely responsible for compliance with applicable consumer protection obligations. Coursivity\u2019s role as a technology intermediary does not create any consumer protection obligations on Coursivity\u2019s part in respect of Vendor Courses or Digital Products.<\/p>\n\n\n\n

                                  6. Policy Modifications<\/h1>\n\n\n\n

                                  Coursivity reserves the right to modify this Refund Policy at any time. Material changes will be communicated by posting the updated version on the Platform with an updated effective date. For material changes affecting subscription billing terms, Coursivity shall provide at least fourteen (14) calendar days\u2019 advance notice via email.<\/p>\n\n\n\n

                                  Continued use of the Platform after the effective date of any changes constitutes acceptance of the revised policy.<\/p>\n\n\n\n
